Fair rent decisions (regulated tenancies)

Every published fair-rent decision for regulated tenancies under the Rent Act 1977, including where the maximum fair rent cap applied.

Why it matters

Regulated tenancies (most began before 1989) have a registered fair rent, capped by the Maximum Fair Rent Order. A different law from Section 13: these figures are never mixed into market-rent statistics.

Abide.Rent keeps the evidence that decides cases like these on file for every tenancy, before the notice goes out.

Questions agents and landlords ask

What is a fair rent?

The rent registered for a regulated tenancy under the Rent Act 1977, mostly tenancies that began before 15 January 1989. It is set by the Valuation Office Agency rent officer, and by the First-tier Tribunal if either side objects.

How much can a fair rent go up?

The Rent Acts (Maximum Fair Rent) Order 1999 limits an increase by a formula: the change in RPI since the last registration, plus 7.5% on the first re-registration after February 1999 or 5% after that. Where it applies, the registered rent is the lower of the fair rent and the cap.

How often can a fair rent be re-registered?

Usually not within two years of the last registration, unless there has been a change in the condition of the home or the terms of the tenancy.
